The Latin American Regional Forum (LARF) of the International Bar Association Legal Practice Division published a special edition of its newsletter to celebrate its 20th anniversary. One of the published articles, Anti-corruption policies: practical aspects of its implementation in Latin America, was a special joint collaboration of several Latin American firms that wanted to be part of this edition of the 20th anniversary of the Forum. The authors were Rodrigo Lavados, of Cariola Diez Pérez Cotapos (Chile); José Carlos Wahle, of Veirano Advogados (Brazil); Luis Alfredo Barragán, of Brigard & Urrutia (Colombia); Mario Pasco Lizárraga, of Rodrigo Elías & Medrano (Peru); and Juan Sonoda, of Beretta Godoy (Argentina). Due to the extraterritorial application of anti-corruption legislation now in force in many countries, multinational companies need to implement policies in all of the jurisdictions that they operate to minimise the risk of non-compliance. Due to unique labour laws in many Latin American countries, implementation needs to be tailored specifically to each jurisdiction. The article analyses the effects of the Foreign Corrupt Practices Act (FCPA) on multinational companies operating in Argentina, Brazil, Chile, Colombia and Peru, with specific focus on its practical consequences from a labour perspective.
