On March 28, 2023, the Federal Tax Authority published General Resolution 5339/2023 which suspended until December 31, 2023, the exclusion regime for the collection of Income Tax and Value Added Tax (“VAT”) on definitive imports of goods.
The measure reaches definitive imports of goods, including those made to the Argentinian free trade zone from foreign countries, and from the free trade zone to the general or special customs territory, unless they are exempt.
As a result of the suspension of this benefit, the Federal Tax Authority is required to collect in advance income tax at a rate of 6% or 11% depending the type of goods being imported and VAT at a rate of 20% for items subject to the general VAT rate of 21%, and 10% for items subject to the reduced VAT rate of 10.5%.
The amounts of income tax collected in advance (percepciones) will be considered as tax paid by importers and therefore, can be computed in their annual tax return.
The amounts collected in advance corresponding to VAT can be computed as tax paid from the ninth monthly fiscal period following the import. |
