Federico Godoy was invited as speaker by the Arbitration Committee of the Inter Pacific Bar Association (IPBA) to the panel on “Sustaining Arbitration and Cultural Approaches – New Challenges & Ideas”. The conference was held in Vancouver on May 8-11 2014.
The session looked at criticisms that arbitration is becoming too expensive and drawn out. The Session chairs sought to present a real dialogue on the challenges facing arbitration and the ideas and proposals that can help sustain it. To provoke serious and thoughtful debate, leading common and civil law speakers discussed some key issues, followed by an interactive discussion with the audience and concluded with the floor taking a vote, before moving onto the next subject for discussion:
The topics discussed were:
– Civil law system arbitrations – Why do they complete much faster than common law ones & are they necessarily more efficient?
– Controlling costs – Should Tribunals take more control of proceedings?
– Fast track arbitration – Has their time come & is there a lesson from successful statutory adjudications that complete in weeks, if not months?
– Witness conferencing – Does this only really work in limited circumstances?
