The project was presented on May 2, 2023. Among the arguments of the project, it is stated that “it is time to break with the extractivist and exporting model, modify the mining code, modify the Mining Investment Law and move forward with a national development model and the defense of our sovereignty”. The most relevant aspects of the project are:
(i) To declare mineral reserves containing lithium as a strategic natural resource.;
(ii) Declare of public interest the exploration, exploitation, exploitation concession, industrialization and all acts related to lithium and its derivatives.;
(iii) Mineral concessions already granted to private companies prior to the effective date of this Law are fully covered by this Law and must comply with its provisions and regulations within one (1) year from its enactment;
(iv) The National State will have the first option to acquire the lithium extracted in our country;
(v) The foreign permit holders and concessionaires existing at the time of the creation of the present law shall have the right over the surplus mineral extracted and may commercialize them.;
(vi) The Executive Authority may limit or prohibit the import or export of lithium and its derivatives when, in cases of urgency, reasons of public interest so advise.
